Abstract
El presente trabajo pone de manifiesto la compleja realidad dela falsificación de objetos arqueológicos. Para aportar alguna luzal respecto, es necesario delimitar el objeto material sobre el querecaen las posibles conductas típicas, así como los modos y fasesde esta falsificación, que, con frecuencia, excede de la propia conducta falsaria, causando daños en los yacimientos arqueológicos. Enconsecuencia, resulta imprescindible delimitar los actos de expolio,para, finalmente, analizar las posibilidades de protección que ofreceel derecho penal ante estos ataques al patrimonio cultural, habidacuenta de la magnitud de estas falsificaciones y el posterior tráficoilícito de estos objetos, caracterizado por la transnacionalidad.
This study highlights the complex reality of the forgery of archaeological objects. To shed light on this problem, it is necessary to define the types of materials serving most often for forgeries, as well as their types and phases. It must be noted that these phases frequently go beyond the act of forgery itself as they provoke damage to archaeological sites. It is therefore essential to define the acts of plunder so as to be able to analyze the possibilities of protection from these attacks on cultural heritage offered by the law taking into account its magnitude and its illicit transnational traffic.
