Abstract
The present work studies from a theoretical perspective the basic elements of the history of the German Jurisprudence of the nineteenth century. The nineteenthcentury German Jurisprudence represents a first-order episode in the history of European law (Pandektenwissenschaft). Its success was first of all due to the interest in the study of the sources, worked in an up-to-date way, on which it was possible to construct a legal dogmatic (Begriffsjurisprudenz) that tried to respond to the new demands of the illustrated system and the needs of change of a new society (Heutiges Römisches Recht). This atmosphere of change led to an intellectual debate about the legal phenomenon and the concept of Justice that still today, two centuries later, persists in very similar terms. Moreover, our current law is a law in crisis, and the study of its past can provide some light to face its future.
