AB El presente trabajo estudia desde una perspectiva teórica los elementos esencialesde la historia de la Jurisprudencia alemana del siglo XIX. Medular parael desarrollo de la ciencia jurídica que habría de consolidarse hasta nuestrosdías, la Jurisprudencia alemana del siglo XIX se considera como un episodio deprimer orden en la historia del derecho europeo (Pandektenwissenschaft). Suéxito se debió en primer lugar al interés por el estudio de las fuentes para trabajarlasde manera actualizada, sobre las que se construyó una dogmática jurídica(Begriffsjurisprudenz) que pretendía responder a las nuevas exigenciasde la sistemática ilustrada y a las necesidades de cambio de una nueva sociedad(Heutiges Römisches Recht). Esta atmósfera de cambios propició un debate intelectualen torno al fenómeno jurídico y al concepto de Justicia que aún hoy,dos siglos más tarde, persiste en términos muy similares. Por lo demás, nuestroactual Derecho es un Derecho en crisis, y el estudio de su pasado puede aportaralgo de luz para afrontar su futuro.
AB The present work studies from a theoretical perspective the basic elements of thehistory of the German Jurisprudence of the nineteenth century. The nineteenthcenturyGerman Jurisprudence represents a first-order episode in the history ofEuropean law (Pandektenwissenschaft). Its success was first of all due to theinterest in the study of the sources, worked in an up-to-date way, on which itwas possible to construct a legal dogmatic (Begriffsjurisprudenz) that tried torespond to the new demands of the illustrated system and the needs of change ofa new society (Heutiges Römisches Recht). This atmosphere of change led to anintellectual debate about the legal phenomenon and the concept of Justice thatstill today, two centuries later, persists in very similar terms. Moreover, ourcurrent law is a law in crisis, and the study of its past can provide some light toface its future.
