Abstract
Este artículo tiene como objeto de estudio los conceptos de Ley, principios jurídicos
y derechos fundamentales, los cuales son analizados a partir de los planteamientos
teóricos del jurista italiano Gustavo Zagrebelsky. A partir de dichas
categorías conceptuales, se intenta replantear el paradigma del nuevo constitucionalismo
proponiendo la viabilidad de un modelo de Estado Constitucional,
donde paralelamente a la importante tarea de ponderación a cargo de los jueces
constitucionales, sobreviva en condiciones de igualdad institucional la trascendente
función del legislador racional. Se propone que este último actúe también
como garante de aquellos principios y derechos, a través de normas de naturaleza
legislativa que permitan un determinado nivel de certeza y seguridad,
tanto en la esfera de los operadores jurídicos como de las personas titulares de
derechos fundamentales.
This article has as purpose of study the concepts of law, legal principles and fundamental rights, which are analyzed as from the theoretical approaches of the Italian jurist Gustavo Zagrebelsky. Based upon these conceptual categories, it is attempted to re-formulate the paradigm of the new constitutionalism, to propose the feasibility of a model or pattern of a Constitutional State, where in a parallel form to the important task of assessment by Constitutional judges, there survives, in conditions of institutional equality, the transcendental function of rational legislators. It is proposed that the latter act also as guarantors of those principles and rights, through provisions of a legislative nature rules that allow for a certain level of certainty and security, both in the sphere of legal operators as well as in that of the individuals endowed with any fundamental rights.
