Abstract
La aprobación del Anteproyecto de Ley de Enjuiciamiento Criminal el 24
de noviembre del 2020 supuso un hito en el camino emprendido hace más de una
década hacia la reforma integral de nuestro proceso penal. Este texto articulado es
la propuesta que más ha avanzado en su tramitación pre legislativa de las tres que
se han elaborado hasta la fecha. A nivel técnico, los lineamientos generales de la
norma, heredera de sus predecesoras, emanan de la Constitución, son compartidos
por la práctica totalidad de los países de nuestro entorno y resultan coherentes
con el proceso de armonización de nuestro ordenamiento jurídico y el Derecho
de la Unión Europea. Por otro lado, desde el punto de vista político, la experiencia
cosechada evidencia que la trasformación integral del sistema procesal penal no es,
ni por asomo, un ejercicio meramente técnico. Queda clara la necesidad de generar consensos entre todos los colectivos afectados por la reforma desde su propia génesis,
lo que dificulta, pero no imposibilita, la aspiración de renovar el modelo, a la
par que supone una exigencia lógica en términos democráticos.
The approval of the Preliminary Draft of the Criminal Procedure Law on November 24, 2020 was a milestone in the path undertaken more than a decade ago towards the integral reform of our criminal procedure. This articulated text is the proposal that has made the most progress in its pre-legislative processing. At a technical level, the general guidelines of the regulation, heir to its predecessors, emanate from the Constitution. These are shared by practically all the countries of our environment and are coherent with the process of harmonization of our legal system and the European Union Law. On the other hand, from the political point of view, the experience gained shows that the comprehensive transformation of the criminal procedure system is not, by any means, a merely technical exercise. It is clear that there is a need to generate consensus among all the groups affected by the reform from its very genesis, which makes it difficult, but not impossible, to renew the model, as well as being a logical requirement in democratic terms.
