Abstract
La salud se concreta en numerosos tratados internacionales como un derecho
humano esencial por su estricta vinculación a la dignidad humana. Es, además,
uno de los derechos sociales que por antonomasia evidencia la función de los
modernos Estados de Bienestar. Desde esa importancia capital, este artículo se
centra en el contexto español actual para valorar la concepción normativa de la
salud como un auténtico derecho, incidiendo en las consecuencias prácticas de
la misma. El análisis de cuestiones como el acceso a la asistencia sanitaria, desde
los parámetros de universalidad y gratuidad; o la calidad de ésta, nos sirve
para evaluar el presente y proyectar alternativas de futuro.
Health is defined in various international treaties as a fundamental human right, which is essential to its close relationship with human dignity. Furthermore, it is one of the social rights which characteristically demonstrates the purpose of modern Welfare States. This article focuses on the current situation in Spain in order to assess the legal regulations of health as basic right, concentrating on the practical consequences. The analysis of issues such as access and quality to free universal medical assistance helps us to evaluate the current situation and propose alternatives for the future.
