Abstract
En este artículo se expone por qué los modelos actuales del proteccionismo "renovado",que consagró la Convención sobre los Derechos del Niño, y social dela discapacidad, que consagró la Convención sobre los Derechos de las Personascon Discapacidad, si bien han supuesto un enorme avance en el reconocimientoy protección de los derechos de los niños, en general, y de los derechos de los niñoscon discapacidad, en particular, resultan finalmente inadecuados conformeal actual modelo de los derechos humanos. Y en esa línea, también se apuntacómo habría que entender un sistema de reconocimiento y protección de los de rechos de los niños, con o sin discapacidad, que resultase satisfactorio conforme al actual modelo de los derechos humanos.
This article explains why the current models of “renewed” protectionism, which enshrined the Convention on the Rights of the Child, and social, which enshrined the Convention on the Rights of Persons with Disabilities, although has been a great advance in the recognition and protection of the rights of children, in general, and the rights of children with disabilities, in particular, are, finally, inconsistent with the current model of human rights. And in that line, it is also pointed out how must be understood a system of recognition and protection of the rights of children, with or without disabilities, that would be consistent with the current model of human rights.
