Abstract
La protección indirecta es un criterio interpretativo del Tribunal Europeo de Derechos Humanos (TEDH) que permite extender la protección del Convenio Europeo para la Protección de los Derechos Humanos y las Libertades Fundamentales y de sus Protocolos a derechos y libertades que no se encuentran reconocidos en sus disposiciones –entre ellos, los derechos económicos, sociales y culturales (DESC)– con el fin de garantizar la efectividad de los sí reconocidos. Sus diversas modalidades de aplicación exponen el potencial de la protección
indirecta como instrumento que refuerza la exigibilidad de los DESC a escala europea. El análisis de la jurisprudencia del TEDH, sin embargo, refleja los límites jurídicos e interpretativos que mediatizan el alcance jurídico de la extensión –estándares básicos– de la protección obtenida por los DESC.
Indirect protection is an interpretative criterion of the European Court of Human Rights (ECHR) that allows extending the protection granted by the European Convention for the Protection of Human Rights and Fundamental Freedoms and its Protocols to rights and freedoms not included in them-- among others, economic, social and cultural rights (ESCR). Its different modalities of application reveal the potential of indirect protection as a tool that strengthen the enforcement of ESCR at the European level. The analysis of the ECSR case-law, however, shows the legal and interpretative limits that diminish the importance of the legal reach of the extension---basic standards--- of the protection granted under the ESCR.
