Abstract
Las violaciones a derechos humanos en México de manera sistemática son un tema de preocupación y alarma. El Derecho Interno no ha conseguido garantizar la protección de los derechos fundamentales ni las reparaciones de los daños. Ha sido a través de instancias internacionales, tales como el Sistema Interamericano mediante la Comisión Interamericana y especialmente de la Corte Interamericana de Derechos Humanos que se ha podido impartir justicia mediante sentencias condenatorias en contra de las autoridades estatales por violaciones a derechos humanos. Dichas violaciones han sido múltiples, ya sea de desaparición forzada, tortura, detenciones ilegales y arbitrarias, violencia de género, garantías de debido proceso, entre muchas más. La Corte Interamericana ha analizado los casos que ha recibido y emitido sentencias paradigmáticas en la materia y que han sido de relevancia amplia para el Estado Mexicano. Es importante tomar en consideración en primera instancia el mecanismo interno de seguimiento de cumplimiento de sentencias, y por otro lado, el impacto que han generado dichas resoluciones dentro de la sociedad mexicana y que han marcado la pauta para robustecer la protección de los derechos fundamentales de todas aquellas personas que se encuentren bajo la jurisdicción de México
Systematic human rights violations in Mexico are a matter of concern and alarm. Domestic law has not been able to guarantee the protection of fundamental rights or reparations of damages. It has been through international instances, such as the Inter-American System through the Inter-American Commission and especially the Inter-American Court of Human Rights, that it has been possible to receive a sentence in respect of the human rights violated by the State authorities. The violations have been multiple, either forced disappearance, torture, illegal and arbitrary detentions, gender violence, due process guarantees, among many others. The Inter-American Court has analyzed the cases it has received and issued paradigmatic judgments on the matter that have been of broad relevance for the Mexican State. It is important to take into consideration, firstly, the internal mechanism for monitoring compliance with judgments, and secondly, the impact that such resolutions have generated within Mexican society and that have set the standard for strengthening the protection of the fundamental rights of all persons under Mexico's jurisdiction
