Abstract
Aunque el ámbito de los delegados sindicales debe ser coincidente con el de las secciones sindicales a las que representan, la sentencia objeto de este comentario modifica el criterio jurisprudencial anterior entendiendo que es una decisión del sindicato la opción por constituir la sección a nivel de empresa o a nivel de centro y, derivada de dicha opción, la de designar al delegado sindical, tomando como referencia uno u otro ámbito. Obviamente tendrá que existir una correspondencia entre el ámbito de la sección y el de designación de los delegados, máxime cuando éste es el mandatado de la sección para actuar como representante de la misma si bien esta concordancia debiera permitir su designación en el ámbito que convenga a la sección, y no en función de los órganos unitarios preexistentes.
