Abstract
This paper presents some aspects of the legal and philosophical thought of the American jurist Catharine MacKinnon, with a particular focus on her negative anthropology and on the reclaiming power of rights. Specific attention will also be given to her view of equality, which refuses the formal logic of the Aristotelian formula (“treating likes alike and unlikes unalike”) in order to emphasise the substantive elements rooted in the social background. Finally, some critical remarks and conclusive reflections will be presented.
Este trabajo presenta algunos aspectos del pensamento jurídico y filosόfico de la jurista estadounidense Catharine MacKinnon, con una atención particular a su antropología negativa y al poder reivindicativo de los derechos. También se presta especial atenciόn a su visiόn de la igualidad, que rechaza la lόgica formal de la fόrmula aristotélica (“tratar igual a los iguales y desigual a los desiguales”) con el fin de enfatizar los elementos sustanciales arrigados en el trasfondo social. Al final se presentan algunos comentarios críticos y reflexiones conclusivas.
