Abstract
The Amnesty Law, is born as a negotiation in two parts. A prior, convened a year after the death of the dictator Francisco Franco, still in Francoist Courts, and a second amnesty, converted into the so-called "Amnesty law ", agreed and drafted by all political groups in the democratic courts, emanating from Parliament, with the exception of Alianza Popular, which voted against it. The article reflects the spirit of its origin, its low subsequent legislative development, and its transformation into legal argument to deny access to Justice and the right to the Effective Judicial Protection, recognized as fundamental rights of the Spanish Constitution of 1978.
