dc.description.abstractEl Anteproyecto de Ley de Enjuiciamiento Criminal de 2020 trata de consagrar definitivamente un cambio de paradigma. El pre-legislador ha pretendido formular un nuevo proceso penal que posibilite un encuentro entre la tradición y la modernidad. Pero, sobre todo, lo que se ha perseguido es que la reforma del proceso penal no se traduzca en una mera reforma normativa, sino que proyecte la idea del Estado de Derecho consagrada en la Constitución, de tal suerte que el proceso encuentre su legitimación en su construcción a partir de los derechos y libertades fundamentales. Por ello, el presente trabajo pretende exponer el recorrido que, durante estos años, estos siglos, se ha seguido por el pre-legislador. En el estudio se exponen las causas y fundamentos del desarrollo legislativo, las características más sobresalientes del anteproyecto, así como algunas consideraciones críticas entorno al mismo.es
dc.description.abstractThe Preliminary Draft of the Criminal Procedure Act 2020 seeks to definitively consolidate a change of paradigm. The pre-legislator has sought to formulate a new criminal procedure that will enable balance between tradition and modernity. Above all, the aim pursued is that the reform of criminal procedure should not be translated into a mere regulatory reform, but should project the idea of the Rule of Law enshrined in the Constitution, in such a way that the process finds its legitimacy in its construction on the basis of fundamental rights and freedoms. For this reason, the present work aims to set out the path followed by the pre-legislator over these years, these centuries.
