Abstract
El sistema residencial de protección en Chile ha sido duramente criticado por fracasar en garantizar un adecuado ambiente de protección y cuidado a los niños y las niñas. La presente investigación busca analizar si la protección que el Estado chileno otorga a la niñez mediante el acogimiento residencial se adapta al modelo de los derechos humanos. Sobre la base de una revisión documental y un análisis descriptivo y crítico, este estudio establece los estándares internacionales de derechos humanos que habrían de considerarse para configurar un sistema de cuidado residencial. A partir de este, se concluye que el actual sistema residencial de protección chileno no se adapta al modelo de los derechos humanos por sus hondas raíces proteccionistas. Con un fuerte énfasis en la caridad, el Estado de Chile ha tendido a delegar la responsabilidad de cuidado y protección de la niñez en entidades privadas, lo que ha comprometido seriamente el ejercicio de los derechos de los niños y las niñas bajo cuidado residencial. Se plantea que este débil compromiso del Estado chileno deviene en un incumplimiento de sus obligaciones internacionales de protección de los derechos de la niñez. Por último, se ofrecen una serie de recomendaciones al Estado de Chile, que buscan adecuar el sistema residencial actual a un modelo de derechos humanos de la niñez.
The Chilean residential protection system has been harshly criticized for failing to guarantee an adequate protecting and caring environment for children. This research aims to analyze if the protection that the Chilean State provides to children through residential care is based on the human rights model. Drawing from documentary research and a descriptive and critical analysis, this study sets out the international human rights standards that would have to be considered to configure a care system. Throughout the analysis it is argued that the current Chilean residential protection system does not adapt to the human rights model due to its deep protectionist roots. With a strong emphasis on charity, the Chilean State has tended to delegate responsibility of children’s care and protection to private entities, seriously compromising children’s exercise of their rights in residential care. It is argued that the weak commitment of the Chilean State to children’s care and protection is a non-fulfilment of its international obligations to protect children's rights. Finally, a series of recommendations are offered to the Chilean State, in order to adapt the current residential system to one based on a children’s human rights model.
