Abstract
Este artículo tiene como objetivo proporcionar una aproximación al Realismo Jurídico Norteamericano desde su exigencia de una jurisprudencia empírica. En el marco de la “revuelta contra el formalismo” que caracteriza la postura teórica de la ciencia social del periodo en la cultura estadounidense, juega un
papel central la influencia de las ciencias psicológicas. Sin embargo, desde la interpretación de Lon Fuller, el behaviorismo psicológico parece ser, para los realistas, más una herramienta lingüística que una teoría, desde la perspectiva de la relación entre orden jurídico y orden social. Recientemente, Brian Leiter se ha centrado en este tema, argumentando que la “Core Claim” del Realismo se basa en una jurisprudencia naturalizada. Estas interpretaciones ayudan a considerar la contribución que el Realismo Jurídico Norteamericano ha ofrecido a la teoría jurídica.
This paper aims to provide an approach to American Legal Realism under the lens of its empirical claim for jurisprudence. In the framework of the “revolt against formalism” that characterizes the theoretical attitude of social science of that period in American culture, the influence of psychological sciences plays a central role. Nevertheless, since Lon Fuller’s earl interpretation, psychological behaviourism seems to be for realists more a linguistic tool than a theory, in the perspective of the relationship between legal and social order. Recently, Brian Leiter has turned to focus on this topic, arguing that the ‘Core Claim’ of the Realism relies in a naturalized jurisprudence. These interpretations help to consider the contribute that American Legal Realism has offered to legal theory.
