Revista de Derecho Patrimonial, 53, pp. 1-271139-7179https://hdl.handle.net/10016/36012Las consecuencias restitutorias que el Código Civil prevé, como forma de conjurar el perjuicio que la enajenación por fraude de acreedores causa a tales acreedores, es un tema verdaderamente complejo. Un análisis detenido de este tema, a la luz de la función institucional que la rescisión por fraude de acreedores cumple en lo que podríamos llamar el Derecho Civil Patrimonial, y teniendo muy presentes los antecedentes históricos, los trabajos preparatorios del Código Civil, y la Legislación Hipotecaria, lleva a conclusiones que pudieran pasar desapercibidas, y pudieran sorprender, a aquel que sólo se limite a la lectura de los preceptos positivos. El objeto del estudio que aquí se presenta, es analizar la naturaleza y efectos de la consecuencia restitutoria propia de la rescisión por fraude de acreedores, incidiendo especialmente en el problema de la oponibilidad de la misma a los terceros subadquirentes, y en la restitución de los frutos que la cosa haya podido generar hasta que la rescisión es declarada.The restitution that the Civil Code envisages as a way of conjuring the damage caused by the alienation with creditor fraud, is a truly complex issue. A careful analysis of this topic, in the light of the institutional function that the rescission for creditor fraud fulfills, and taking into account the historical background, the preparatory works of the Civil Code, and the Mortgage Legislation, leads to conclusions that could go unnoticed, and might surprise, to one that is limited only to the reading of the positive precepts.
