Se intenta justificar el delito de negacionismo como forma de reconciliarnos con nuestro pasado. 4) Repensar la memoria para entender el derecho a través del pasado a fin de conseguir un presente razonable y un futuro auténtico. 5) Por último, se señalan algunas conclusiones.The paper is divided into five sections: 1) Philosophical and legal analysis of the memory after Auschwitz to understand the present returning to the past, so prudently look to the future in the rule of law. 2) Study of the consensus and language after the Second World War, understood the first as an overrated concept, but also as a necessary element to determine the law. 3) The starting point is the consensus after the postwar period set in the context of hate speech.
