Sin embargo, ello no ha impedido que, por interpretación, los sistemas de protección de derechos humanos hayan desarrollado en su jurisprudencia un conjunto de estándares relacionados a este derecho. En el sistema interamericano, estos estándares se construyeron, principalmente, sobre la interpretación de cuatro derechos civiles y políticos: propiedad, vida, integridad e igualdad y no discriminación. However, this has not precluded the formation of a set of standards that have developed out of the jurisprudence of human rights protection systems in addressing this right.
