AB En este artículo apuntaré una posible línea de investigación sobre lahistoria y teoría del precedente vinculante, uno de los aspectos centrales del ruleof law en países de la familia angloamericana. Entre otras cosas describiré cómo,aunque esta doctrina tiene unos orígenes relativamente recientes, la idea deprecedente puede remontarse a la propia formación del common law. Tambiénhablaré brevemente de la aparición de la moderna doctrina del precedente y quérelación guarda con el desarrollo medieval anterior. Este marco me servirá paraencuadrar y esbozar qué posible línea de investigación se pueden abrir.
AB In this article, I will propose a line of research about the theory andhistory of the doctrine of precedent, one of the crucial elements of the rule of lawof the Anglo-American legal family. Among other things, I will show how the ideaof precedent goes back to the formative period of the common law. I will alsodiscuss the emergence of the modern doctrine of precedent as well as how isrelated to its medieval development. Upon this framework, I will discuss myproposed line of research.
