AB Este trabajo examina cómo puede entenderse la rehabilitación del autor dentro dela Justicia Restaurativa. Considerando que conceptos como la reinserción de quienha delinquido se han planteado, fundamentalmente, dentro del Derecho penal,teniendo como centro de análisis los fines de la pena, cabe preguntarse si las tesispreventivo especiales pueden aplicarse también respecto de la JusticiaRestaurativa, considerando que ésta descansa sobre otros pilares distintos a lapena. Asimismo, se analiza si las prácticas restaurativas pueden tener impacto enla reducción de la reincidencia y de qué forma pueden entenderse hoy nocionescomo el desistimiento delictivo, en cuanto a impulsar cambios en la conducta delofensor hacia la evitación en la comisión de nuevos delitos.
AB This paper examines how the rehabilitation of the offender can be understoodwithin Restorative Justice. Considering that concepts such as the reintegration ofthose who have committed a crime have been raised, fundamentally, withinCriminal Law, having as the center of analysis the purposes of punishment, it isworth asking whether the special preventive thesis can also be applied toRestorative Justice, considering that this rests on other pillars other thanpunishment. Likewise, it is analyzed whether restorative practices can have animpact on the reduction of recidivism and in what way notions such as criminaldesistance can be understood today, in terms of promoting changes in theoffender's behavior towards the avoidance of committing new crimes.
AB In diesem Papier wird untersucht, wie die Rehabilitation des Täters im Rahmender opferorientierten Justiz verstanden werden kann. In Anbetracht der Tatsache,dass Konzepte wie die Wiedereingliederung des Täters grundsätzlich im Strafrechtaufgeworfen wurden, wobei die Ziele der Bestrafung im Mittelpunkt der Analysestanden, stellt sich die Frage, ob die These der Spezialprävention auch auf die"Restorative Justice" angewendet werden kann, da diese auf anderen Säulen alsder Bestrafung beruht. Ebenso wird untersucht, ob sich restaurative Praktiken aufdie Verringerung der Rückfälligkeit auswirken können und inwiefern Begriffe wiekriminelle Desistenz heute im Sinne der Förderung von Verhaltensänderungen desStraftäters zur Vermeidung neuer Straftaten verstanden werden können.
