AB In 2011, 60 women died in Spain, victims of violence by men who were, or had been their partners. They died by the hands of those who were supposed to take care and protected them, those who should have loved them. What took place on Spain, also occurred in Argentina, Brazil, Chile and Mexico, sometimes with more cruelty. This phenomenon cannot be ignored by those who work with human rights protection, because it is, essentially, a human rights issue. The challenge against gender based violence is one of the front lines, perhaps the most painful one, in the battle for the empowerment of women, for the conquer of effective equality between men and women. This is a combat protected by several legal instruments, the most sophisticated and perfect ones of which are in Latin America, where also some interesting legal rules and court decisions are taken aiming the eradication of sexist violence. These few pages testify the phenomenon of sexist violence in Latin America, describing the international landmark for the protection of women and analyses the instruments developed in the area to prevent women from being structural victims of the community they live in.
AB Em 2011, 60 mulheres morreram na Espanha, vítimas da violência de homensque eram ou haviam sido seus parceiros. Elas morreram nas mãos daquelesque deveriam tê-las cuidado e protegido, daqueles que deveriam tê-las amado.O que aconteceu na Espanha aconteceu também na Argentina, no Brasil, noChile, no México; muitas vezes, com maior crueldade. Esse fenômeno nãopode deixar indiferentes aos que trabalham no campo da proteção e garantiados direitos humanos, porque se trata, essencialmente, de um problema dedireitos humanos. A luta contra a violência de gênero é uma das frentes, talveza mais dolorosa, na guerra pelo empoderamento da mulher, pela conquistada igualdade efetiva entre homens e mulheres. Uma guerra a cujo serviço seencontram inumeráveis instrumentos jurídicos, sendo característica da AméricaLatina a criação de alguns dos mais sofisticados e perfeitos, bem como dealgumas das normas e decisões judiciais mais interessantes no que diz respeitoà erradicação da violência machista. Estas poucas páginas atestam o fenômenoda violência machista na América Latina, descrevem o marco internacional deproteção da mulher e se detêm nos instrumentos desenvolvidos na região parafazer com que as mulheres deixem de ser vítimas estruturais das sociedadesem que vivem.
