AB El trabajo tiene por objeto llevar a cabo una comparación entre las teorías iusfilosóficasde los derechos humanos elaboradas por Gregorio Peces-Barba y AntonioPérez Luño, centrando la atención sobre ciertos problemas vinculados con la delimitaciónconceptual de los derechos, así como sobre la relevancia que estos autoresatribuyen a la dimensión histórica. El tema de la historicidad de los derechosconstituye probablemente el terreno sobre el que mejor se puede medir el diálogoentre los autores. A este respecto, puede detectarse una convergencia sustancialen la asunción de la historia como instancia explicativa y no justificativa de losderechos. Al analizar el debate filosófico llevado a cabo entre ambos pensadores seprocurará poner de relieve las diferencias y los elementos de vecindad teórica.
AB The work aims to carry out a comparison between the human rights theories developedby Spanish legal philosophers Gregorio Peces-Barba and Antonio Perez Luño,focusing on certain issues related to the conceptual delimitation of rights, and on therelevance that these authors attribute to the historical dimension. The historicity ofhuman rights probably constitutes the best ground to measure the dialogue betweenthese authors. In this regard, a substantial convergence can be detected with respectto the understanding of history in explanatory terms, rather than as a justifying tool.When analysing the philosophical debate held between these two thinkers, we willseek to highlight the respective differences and elements of theoretical affinity.
