AB El sistema de seguridad social incluye la posibilidadde establecer mejoras voluntarias a lasprestaciones básicas que conforman su núcleoduro. Estas mejoras revisten una naturalezavoluntaria, complementaria y privada y pueden ser creadas por voluntad del empresario o medianteacuerdo con el trabajador o sus representantes.Esta última vía, la más habitual, otorga al conveniocolectivo un papel central en la creación ydesarrollo de esta fórmula de previsión socialcomplementaria. El presente comentario analiza lospuntos básicos establecidos por la jurisprudenciaen torno a la interpretación de las cláusulasconvencionales que complementan las prestacionespor incapacidad temporal.
AB The social security system includes the possibilityof setting voluntary improvements to the basicprotection provided byb the compulsory side.Thesefringe benefits have a voluntary, complementaryand private nature.They may be created by the soleemployer’s will or by agreement with the employeeor his representatives.The last one is usually themost common way and, consequently, collectivebargaining agreements play an essential role in thecreation of this kind of complementary socialprotection.This paper analyses the most importantpoints set by the case law in order to interpret theclauses which create voluntary improvements tosickness benefits.
