T2 Governance in sport in Spain. Some practical examples

AB El  objetivo  del  artículo  es  describir  los  instrumentos jurídicos  reguladores  de  la gobernanza en el deporte en el ordenamiento jurídico español. Para ello se analizan, por un lado, los antecedentes normativos existentes en la materia en España y, por otro lado, se  expone  el  marco  legal  aplicable  a  dicha  materia  en  la  actualidad.De  esta  formay, desde   un   punto   de   vista   metodológico, se exponen los diferentes instrumentos legislativos  aprobados tanto desde  el  punto  de  vista  del Derecho  público estatal como por  partede  las  principales  instituciones  deportivas  delpaísdesde  la  perspectiva  del Derecho privado de auto organizaciónde éstas. Tras dicho análisis se realizan toda una serie de conclusiones. Una primera conclusión es positiva dado que comienzan a existir diferentes instrumentos jurídicos reguladores de la gobernanza en el país, tanto desde el Derecho público como desde el Derecho privado. Por otro lado, otra conclusión se sitúa en  la  imperiosa  necesidad  y  conveniencia  de  seguir  profundizando  en  la  regulación pública para otorgar un adecuado marco jurídicoa la gobernanza del deporte en España
AB The objective of the article is to describe the legal instruments regulating governance in sport in the Spanish legal system. To this end, on the one hand, the existing normative antecedents on the matter in Spain are analyzed and, on the other hand, the legal framework applicable to this matter at present is exposed. In this way, and from a methodological point of view, the different legislative instruments approved both from the point of view of state public law and by the main sports institutions of the country from the perspective of the private right of self-organization are exposed. After this analysis, a series of conclusions are made. The first conclusion is positive given that there are different legal instruments regulating governance in the country, both from public law and private law. On the other hand, another conclusion lies in the urgent need and convenience of continuing to deepen public regulation to provide an adequate legal framework for the governance of sport in Spain.
