AB En el presente ensayo se trata de rastrear la relación que mantiene Hans Kelsencon el pensamiento de la llamada traditionelle Rechtslehre. Desarrollaremoslas críticas que realiza Kelsen a sus antecesores, convirtiéndose así en un herederoingrato. En el segundo y tercer apartado nos centraremos en la idea kelsenianade pureza, la cual tradicionalmente se ha entendido procedente del influjode Kant. Aquí defendemos que sus huellas se hallan también en la obra de CarlFriedrich von Gerber.
AB This essay traces the relationship between Hans Kelsen and the traditionelleRechtslehre. We will develop their confrontation, becoming an ungratefulheritor. In the second and third parts, we will focus on Kelsen´s idea of purity,which traditionally has been understood from the influence of Kant. Here weargue that its marks are also found in the work of Carl Friedrich von Gerber.
