Niños, niñas, niñes y adolescentes trans* en España. Voces silenciadas, experiencias invisibles y derechos inalcanzados

Abstract

En las últimas décadas han surgido nuevas realidades que habían permanecido ocultas y silenciadas por la sociedad, con el amparo del Derecho, también español. Este es el caso de niños, niñas, niñes y adolescentes trans*, víctimas de la interseccionalidad de dos sistemas de opresión que han determinado el modelo de tratamiento y reconocimiento de sus derechos: el proteccionismo y el cisheteropatriarcado. Es necesario dejar atrás el prisma de la patología y la incapacidad, avanzando a aquel de la diversidad y la autonomía, visibilizando las realidades y experiencias de las personas menores de edad cuyas identidades no entran en los límites de la normatividad ficticia. Es por ello que en esta investigación de fin de máster se analizarán los presupuestos teóricos que nos han llevado a la situación de desprotección de sus derechos humanos en el Ordenamiento jurídico español, y se abogará por un auténtico cambio de paradigma, hacia un modelo que sea verdaderamente efectivo y adecuado a sus necesidades específicas.

In recent decades, new realities have emerged that had remained hidden and silenced by society, under the support of the Law, also in Spain. This is the case of trans* children and adolescents, victims of the intersectionality of two systems of oppression that have determined the model of treatment and recognition of their rights: protectionism and cisheteropatriarchy. It is necessary to leave behind the prism of pathology and incapacity, advancing to that of diversity and autonomy, making visible the realities and experiences of minors whose identities do not fall within the limits of fictitious normativity. That is why this master's thesis will analyze the theoretical assumptions that have led us to the situation of lack of protection of their human rights in the Spanish legal system, and will advocate for a real paradigm shift towards a model that is truly effective and appropriate to their specific needs.
