La tensión entre la libertad ideológica y la libertad de empresa

Abstract

Por sus ideas o creencias, el trabajador puede resultar objeto de un trato desigual y perjudicial, esto es, ser víctima de un trato discriminatorio por motivos ideológicos. Este trabajo pretende dibujar el marco jurídico de la protección frente a este trato a través de la tensión entre el ejercicio de la libertad ideológica y la de empresa, configuradas por un contenido propio garantizado y un alcance delimitado por las obligaciones de la relación laboral. Este análisis debe contemplar la posibilidad de que la empresa adopte un ideario propio que pretenda alcanzar a través de sus facultades empresariales, imponiendo obligaciones de carácter ideológico al trabajador.

Because of own ideas or beliefs, the worker may be treated unequal and harmfully, that is, be victim of a discriminatory treatment. This work aims to draw the legal framework of the protection against this type of treatment through the tension between the exercise of ideological freedom and the freedom of enterprise. The exercise of both freedoms is set by an own guaranteed content and a scope delimited by the rights and obligations of the employment relationship. This analysis must contemplate the possibility that a company would take its own ideas or ethical standards that it would try to achieve by entrepreneurial power, imposing ideological obligations on the worker.
