La importancia de la Declaración Americana de los Derechos y Deberes del Hombre en el Sistema Interamericano y la interpretación que de ella realiza la Corte Interamericana

Abstract

El artículo aborda los antecedentes, el nacimiento, el contenido, la evolución y las principales características de la Declaración Americana de los Derechos y Deberes del Hombre aprobada en 1948 en el marco de la Organización de los Estados Americanos, una organización regional americana que desempeña un papel importante en lo que hoy se conoce como Sistema Interamericano de los Derechos Humanos. Asimismo, se analiza la interpretación que sobre ella ha realizado la Corte Interamericana de Derechos Humanos en sus años de funcionamiento, especialmente sobre el valor jurídico, a través de su jurisprudencia, opiniones consultivas y sentencias.

The article deals with the antecedents, the origen, the content, the evolution and the main characteristics of the American Declaration of the Rights and Duties of Man approved in 1948, within the framework of the Organization of American States, an American regional organization, that performs a importat role in what is now known as the Inter-American System of Human Rights. It also analyzes the interpretation that the Inter-American Court of Human Rights has made about it in its years of operation, especially on the legal value, through its jurisprudence, advisory opinions and judgments.
