Os direitos sociais no Brasil do século XXI: uma releitura dos direitos fundamentais de forma a garantir a eficácia das prestações afirmativas de um estado democrático de direito

Abstract

O trabalho tem por objetivo analisar a eficácia da garantia dos direitos sociais no Estado Brasileiro do século XXI, baseando-se na necessidade das ações afirmativas estatais, perfazendo-se um estudo sob a perspectiva de uma nova releitura dos direitos fundamentais. Assim, a pesquisa traz uma análise acerca da evolução dos direitos sociais, sua aplicação e seus problemas. O estudo apresentará as dificuldades enfrentadas para efetivar os direitos de um Estado do bem estar social. Por fim, cumpre analisar a necessidade de uma nova leitura dos direitos fundamentais, pautada no princípio da dignidade da pessoa humana e no princípio da solidariedade.

The objective of this study is to analyze the effectiveness of the guarantee of social rights in the Brazilian State of the 21st century, based on the need for affirmative state actions, with a study based on the perspective of a new rereading of fundamental rights. Thus, the research brings an analysis about the evolution of social rights, its application and its problems. The study will present the difficulties faced to realize the rights of a welfare state. Finally, it is necessary to analyze the need for a new reading of fundamental rights, based on the principle of the dignity of the human person and the principle of solidarity.
