La regulación inglesa de la responsabilidad por los daños causados por animales. Un estudio comparado con el derecho español

Abstract

En este trabajo estudiamos la regulación inglesa de la responsabilidad civil por daños causados por animales y hacemos un análisis comparado con la regulación española sobre el particular. Esto con el doble propósito de informar y mejorar ambas regulaciones en la medida en que puedan aprender la una de la otra y de sentar las bases de una futura regulación europea de la responsabilidad civil por los daños causados por animales, pues los puntos en los que coinciden pueden contribuir a una regulación homogénea de esta responsabilidad. La casuística de la especial regulación inglesa soluciona problemas que en España han tenido que resolver la doctrina y la jurisprudencia (e.g. asunción del riesgo por parte de los empleados), pero la claridad de la regulación española evita problemas de entendimiento e interpretación de la norma (e.g. clasificación del tipo de animal).

This paper studies the English regulation of civil liability for damage caused by animals and makes a comparative analysis with the Spanish regulation thereof. This, with a double purpose. On the first hand, to inform and improve both systems in as much as they can learn from each other. On the second hand, to set the basis of a future European regulation of the civil liability for damage caused by animals, because the points in which they coincide can contribute to a homogeneous regulation of this liability. The specialty of the English regulation solves problems that in Spain have been faced by the doctrine and court decisions (ex. assumption of risk by employees). But the clarity of the Spanish regulation avoids the need of interpretation (ex. classification of animals) and the difficulty to understand the provisions of the Animals Act.
