Los derechos y libertades de los inmigrantes en el modelo estadounidense. A propósito de la Arizona Inmigration Law SB 1070

Abstract

El presente estudio analiza las principales políticas públicas y la legislación estadounidense en el contexto migratorio, con el objeto de determinar cuáles son sus principales virtudes y lagunas. Con este objetivo, se intenta dar respuesta a cuestiones como, por ejemplo, ¿quién tiene la competencia para regular la inmigración?, ¿cómo ha evolucionado la política migratoria?, ¿por qué residen más de 11 millones de inmigrantes indocumentados en Estados Unidos?, o ¿qué derechos reconoce el ordenamiento jurídico a los inmigrantes indocumentados? Una vez respondidas estas cuestiones, se analizan los motivos que han impulsado al legislador de Arizona a aprobar una ley que criminaliza la inmigración ilegal, cuáles han sido los argumentos utilizados por el gobierno federal para recurrir su ejecución, y por qué motivos ha sido suspendida cautelarmente la aplicación de la norma de Arizona.

This paper analyzes the main public policies and US law in the immigration context, in order to identify the main strengths and gaps of the US migration model from the immigrants’ perspective. According with this approach this study tries to answer questions such as, for example, who has the power to regulate immigration? How immigration policy has evolved? Or why live more than 11 million undocumented immigrants in the US? Once answered these questions, the study is focus on the local level, and try to analyze which have prompted the Arizona legislature to pass a law that criminalizes illegal immigration, what were the arguments used by the federal government to appeal its execution, and what arguments have used the federal courts to suspend provisionally the application of the Arizona Immigration Law.
