Abstract
Uno de los objetivos de este estudio es analizar la polémica sobre las relaciones entre Derecho y moral de Eugenio Bulygin y Robert Alexy, considerados dos de los mayores teóricos y filósofos del Derecho. Primero, en el estudio se considera las características de los aspectos fundamentales de la controversia entre el Derecho y la moral. Luego, el enfoque se dirige a la tesis no positivista de Alexy sobre el argumento de la pretensión de corrección como un elemento necesario del Derecho y sus argumentos a favor de una conexión entre Derecho y moral. A continuación se analiza la tesis positivista de Eugenio Bulygin, que sostiene la concepción contraria, es decir, enfatiza la separación entre el Derecho y la moral, y sus críticas basadas en la afirmación de la concepción del Derecho como una ciencia puramente descriptiva y no evaluativa, con un escepticismo ético. Ciertamente algunas de las características de la filosofía de Alexy y de Bulygin y algunos de sus escritos sobre la filosofía jurídica han provocado frecuentes cuestionamientos.
One of the aims of this study is to analyze the relationship between Law and morality through Eugenio Bulygin and Robert Alexy who could be considered two of the most important legal theorists and legal philosophers. First, the paper considers characteristics of the fundamental features of the controversy between Law and morality. Then, the focus turns to Alexy’s non-positivist thesis about the argument of the claim of correctness as a necessary element of the Law and his arguments in favor of a connection between Law and morality. Next, on the contrary, Bulygin, a positivist, emphasizes the separation between Law and morality. Criticisms formulated by Eugenio Bulygin affirm the conception of the Law as a purely descriptive and non-evaluative science, in addition to an ethical skepticism. Undoubtedly some of the characteristics of Alexy’s and Bulygin’s philosophies and some of their writings on legal philosophy have caused frequent questioning.
