Abstract
En este trabajo se asume que el Estado constitucional es un modelo de articulación de las relaciones entre el Derecho y el Poder que se produce como consecuencia de un proceso histórico. Por ello, se intentan analizar alguno de los rasgos que nos permiten comprender al Estado constitucional como una realidad histórica. Se aborda la cuestión del significado histórico del Estado como forma moderna de organización del Poder político. Desde el momento en que el Estado constitucional está vinculado a un determinado concepto de Constitución, es necesario mostrar los rasgos más sobresalientes de éste último. A partir de ahí, se pueden plantear los rasgos más importantes del Estado constitucional y alguno de los conflictos que se plantean en su interior. Por último, el desarrollo del Estado constitucional, condicionado por su significado histórico, apunta, al menos desde el punto de vista teórico, en una dirección cosmopolita que supera las fronteras estatales.
ln this article it is assumed that the constitutional State is a model of articulation of the relationship between Law and Power, which occurs as a consequence of a historical process. For this reason, the article aims to analyze some of the features that allow us to understand the constitutional State as a historical reality by means of an analysis of the issue of the historical meaning of the State as a modern form of organization of political Power. Since the constitutional State is linked to a certain concept of Constitution, it is necessary to show the most important features of the latter. This allows us to analyze the most salient features of the constitutional State and some of the conflicts that appear in it. Finally, the development of the constitutional State, determined by its historical meaning, appears, at least from the theoretical point of view, in a cosmopolitan direction that overcomes the State borders.
