Cuestiones jurídicas sobre el derecho al desarrollo como derecho humano

Abstract

El derecho al desarrollo es objeto de interesantes debates en la doctrina iusinternacionalista. En este trabajo se analizan las cuestiones clave de este debate: la existencia del derecho –a través del examen de su pertenencia a la categoría de derechos humanos y el análisis de su normatividad– y su contenido –valorando las aportaciones doctrinales y las realizadas por el Experto independiente sobre el derecho al desarrollo.----------------------------------------------------------The right to development is the aim of important debates among international lawyers. This article analyses the keys of this debate: the existence of the right –testing its quality as a human right and analysing its normative quality– and its content –by means of international law literature and the contributions of the United Nations Independent Expert on the right to development.
