Abstract
El fenómeno de las migraciones se ha erigido en una de las cuestiones clave en
la agenda internacional e interna de los Estados y de los organismos internacionales.
En España, los movimientos migratorios se dan, en el presente e históricamente,
en una doble dirección: somos país de destino y país de origen. Esto
implica el análisis de cómo garantizar los derechos de los que llegan pero
también los de los españoles que residen en el exterior.
En el contexto de la reciente reforma de la Ley electoral española, urge analizar
cuáles son los derechos de estos últimos. En este trabajo, después de un recorrido
histórico por las leyes que han regulado la emigración, se presenta un
análisis de los derechos de participación, en concreto, los de participación política,
que son, por otra parte, una de las mayores reivindicaciones de los inmigrantes
residentes en nuestro país.
The phenomenon of migration has emerged as one of the key issues in the international and domestic agenda of countries and international organizations. In Spain, migratory movements are currently happening and have also taken place in two different ways: Spain is both a country of destination and a country of origin. This involves the analysis of how to ensure the rights of those who come over to Spain but also for the Spaniards who live abroad. In the context of the recent reform of the Spanish Electoral Act, it urges to analyze what the rights of the Spaniards who live abroad are. First, a historical review of the laws that have regulated migration is presented with a subsequent focus on the rights of participation. Second, given the fact that the Spanish Electoral Act has been recently updated, a study on the rights of political participation is presented. These types of rights are also one of the major demands of the immigrants who are living in our country.
