| Abstract: | Este trabajo analiza dos aspectos relevantes en la teoría del derecho: a) que una noción deductiva del derecho como institución no es posible; b) la lógica sólo puede funcionar como elemento de análisis de las teorías científicas, pero no como unidad conceptual para describir el fenómeno jurídico.
This research analyzes two relevant aspects in the legal theory: a) A deductive notion of law as an institution is not possible; b) The logic only can works as an element of analysis of the scientific theories, but not as a conceptual unit to describe the juridical phenomenon. |
